Assumption of Risks:
Participation in running and conditioning programs carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I know that running is a potential hazardous activity and certify that I am in good health and physically fit enough to enter into a training program. I acknowledge that the ACE RUNNERS Coach and Marathon Training Club (hereinafter the ‘ACE’) has not undertaken any physical test or examination (by itself or through any other doctor or expert) before enrolling me for the program. The sole basis for enrolment is my declaration. I acknowledge that I am aware of the many risks involved in athletic training in general and running training specifically, which risks include by way of example and not limited to: 1) Minor injuries such as scrapes, bruises, sprains and strains, 2) more serious injuries such as joint, muscle and bone injuries, concussions and other head injuries, heath related injuries such as heat stroke and heat exhaustion, dehydration and over hydration conditions such as hyponatremia, and catastrophic injures and conditions such as heart attacks and other conditions or injuries which could be fatal.
I know, understand, and appreciate the above and other risks that are inherent in training for and participating in road, trail and track running and racing and any other conditioning and cross training activities associated with that training. I also understand the risk of participating in any training / event on a course with vehicular traffic, even if the course may be regulated /policed. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification:
I agree to indemnify and hold harmless ACE from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in ACE training program.

Severability:
The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by laws of India and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Waiver of Liability:
I, for myself, my heirs, personal representatives and assigns, do hereby release, waive, covenant not to sue and discharge ACE or any of its coach, partners, employees, affiliates from liability from any and all claims including the negligence (except case of grossest and proved negligence) of ACE, its coach, employee, affiliates etc resulting in personal injury, accidents, illnesses (including death), and property loss arising from, but not limited to, participation in ACE personalized coaching.
I, for myself and my legal representatives, waive all claims of whatsoever nature against the training/coaching by ACE and its sponsors, volunteers and all other persons and entities associated with the ACE, but not limited to, any claims that might result from me participating in the program and whether on account of illness, injury, death or otherwise.
I agree that if I am injured or taken ill or otherwise suffer any detriment whatsoever, I hereby irrevocably authorize the ACE officials to, at my own risk and cost, transport me to a medical facility and/or to administer emergency medical treatment and I waive all claims that might result from such transport and/or treatment or delay or deficiency therein. I shall unequivocally pay and reimburse to you all my medical and emergency expenses without any demur or reservation immediately on presentation of a bill by ACE and I hereby authorize you to incur the same. I agree that nothing here in shall oblige the ACE and all other persons and entities associated with the ACE to incur any expense, or to provide any transport or treatment.
In case of any illness or injury caused to me or death suffered by me due to any medical reasons or medical condition during the program or at any time thereafter as a result of the program, regardless or not whether such medical reasons or condition shall have been pre-existing conditions known by me and further regardless of whether I shall have disclosed, at any point in time, the existence of such a reason for condition to any person, trainer or ACE and its sponsors, volunteers and all other persons and entities associated with the ACE, it/ they shall not be held liable by me or my representatives.
I, for myself and my legal representatives, waive all claims of whatsoever nature against the ACE and its promoters, trainers, volunteers and all other persons and entities associated with the ACE, for any illness or injury caused to me or death suffered by me due to any medical reasons or medical condition during any future marathon event/s.

Acknowledgment of Understanding:
I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and I understand that I am giving up substantial rights. I acknowledge that I am accepting the agreement freely and voluntarily, and intend by my acceptance to be a complete and unconditional release of all liability to the greatest extent allowed by law.
I accept to allow ACE to send me transactional and promotional sms/email on my registered cellphone and email address shared with them.
